The purpose of a will or a trust is to manage how your assets, property, and sometimes personal affairs are handled after your death (and, in some cases, while you’re still alive). While they overlap in some areas, they serve slightly different functions. A trust is a legal arrangement where one party (the trustee) holds and manages property for the benefit of another (the beneficiary). A will is a legal document that expresses your wishes regarding your property and guardianship after death. CONSERVATORSHIPS

A conservatorship is a legal arrangement in which a court appoints an individual, called a conservator, to manage the financial, medical, or personal affairs of another person, known as the conservatee. The conservator is legally obligated to act in the best interests of the conservatee. Conservatorships are often established for individuals who are unable to make important decisions for themselves due to conditions such as dementia, severe mental illness, intellectual disabilities, or a risk of self-harm. Our office assists in drafting all necessary conservatorship paperwork, ensuring it meets court requirements.

POWER OF ATTORNEY

A Power of Attorney (POA) is a legal document that allows one person (the principal) to grant another person (the agent or attorney-in-fact) the authority to act on their behalf in certain matters. The scope and duration of that authority depend on how the POA is written. A POA is used to let someone you trust make decisions or take actions for you when you cannot do so yourself, temporarily or permanently. It can prevent delays, protect your interests, and provide peace of mind. A Power of Attorney lets you choose someone you trust to handle your finances, healthcare, or legal matters when you can’t. A Conservatorship is court-appointed for those who can’t safely manage on their own.
